For a couple facing divorce in China, one thing they needs to consider is how to decide the upbringing payment amount by the party who will not live with his/her child.

Under Chinese Marriage Law and judicial interpretations, deciding  upbringing payment  nees to consider several factors: 1) actual need of the child; 2) income/capacity of husband and wife; and 3) local living standard.

The upbringing payment will cover the living cost, education cost and medical cost of the child. However, it shall not include luxury expense for the child. 

If there is a  real need to increase the child support payment after divorce, the party who is living with the child may demand the other party to pay more.
